Ada Gates Patton became the first woman in the United States and Canada licensed to shoe Thoroughbred racehorses. In her youth in New York and Long Island, Ada competed in show jumping and fox hunting for 20 years. After universities, Ada owned a ranch in Colorado and started shoeing Western horses on ranches and racetracks. Ada moved to Southern California to work on Thoroughbreds at Santa Anita, Hollywood Park, and Del Mar where she achieved Journeyman status. She maintained an active full time shoeing career for over 36 years. Ada owns and operates Harry Patton Horseshoeing Supplies in Monrovia, CA. She is the widow of Harry Patton, her mentor.

Keeping Pedestrians Safe

Pedestrian safety is not solely the responsibility of pedestrians; every driver carries just as much responsibility as any pedestrian.  While there are certain actions that pedestrians can take to become a better pedestrian, there are numerous tips and guidelines drivers can follow to protect pedestrians.  Pedestrians involved in a car crash are at extreme risk of injury and even death, which in some circumstances a driver can be held accountable for.  It is always important to practice defensive driving, but it is imperative to practice defensive driving in the presence of pedestrians, especially in urban areas.  More than 6,000 pedestrians were killed in 2019, accounting for about 17 percent of all crash-related fatalities that year. Driver Tips for Pedestrian Safety
  • Assume Responsibility - It is your responsibility as a driver to be conscious of the safety of pedestrians.  Simply acknowledging that pedestrians are out there will go a long way towards ensuring a safe drive for you and a safe trip for them.
  • Identify Pedestrians - Make a mental note when you see a pedestrian.  Knowing there are pedestrians in the immediate area can help you react to unexpected situations.
  • Avoid Distracted Driving - It is difficult to identify pedestrians if you are not watching the road.  Distracted driving is extremely dangerous for both drivers and pedestrians.  Do not text and drive.
  • Avoid Drunk Driving - Driving under the influence is against the law and carries stiff penalties.  Drivers impaired by alcohol or drugs who injure a pedestrian can face jail time.  Impaired drivers who seriously injure a pedestrian could face stiffer penalties.  Impaired drivers who kill a pedestrian could face vehicular manslaughter charges.
  • Look Both Ways Before Turning - If you are turning right, you may be focused only on traffic approaching from your left.  You should also focus on potential pedestrians approaching from your right.  Ensure there are no pedestrians in any direction before beginning your turn.
  • Look Behind You - Be sure to check your rearview mirror, side mirrors, and backup camera when reversing, especially in parking lots or driveways.
  • Obey Speed Limits - Speeding reduces reaction time.
  • Obey Traffic Signals - In addition to not crashing into other vehicles, obeying red lights and stop signs will prevent drivers from crashing into pedestrians too.  Traffic signals often have crosswalks as well.
  • Obey Crosswalk Rules - Pedestrians always have the right-of-way in crosswalks, marked or unmarked.  Drivers should stop before the crosswalk, stop light, stop sign, or marked stop line.
  • Do Not Pass Stopped School Buses - If a bus has its stop sign arm extended, drivers in both directions are legally required to stop except in certain circumstances.  See our previously published guide on stopping for school buses.
  • Never Assume - We all know the saying, but drivers should never assume that any pedestrian will behave in a predictable manner.

What is a Change of Venue Request?

[vc_row][vc_column][vc_column_text]In most criminal cases, trials occur in the same county (or county equivalent) as where the alleged crime took place.  However, when criminal defense attorneys do not believe that their client can receive a fair trial in the case's assigned location, they may request a change of venue.  There are several circumstances a court would consider before agreeing to a change of venue request, but if the court agrees that it is unlikely that an impartial jury can be secured in the assigned venue, it may agree to the defense's request. In most criminal cases there will not be a need for a change of venue, even if the alleged crime took place in the same county as the assigned court.  Every defendant has the right to fair trial with an unbiased jury, which can usually occur in the home jurisdiction.  However, sometimes reasons may arise that warrant a change of venue.  If a case receives significant pretrial publicity, it may be difficult to pick a jury who is not aware of the case and shows no knowledge of alleged events.  If a defendant is facing obstacles from perceived biases or possible political interference, it may be difficult to receive a fair trial.  Any other considerations that could lead to a court acknowledging that a defendant could be pre-judged by a jury could result in a change of venue request being granted. Even if the reasons for seeking a change of venue seem apparent, there is no guarantee that the court will honor the request.  There are many factors the courts must consider for a change of venue request, including where to move the trial and ensuring any assigned location can meet the needs of the trial.  A change of venue may also be granted in a way that the trial takes place in the original jurisdiction, but they jury is selected from another county.  Hiring an experienced criminal defense attorney will increase the chances that a change of venue request is accepted, as the attorney will know what questions to ask and which evidence to present to the court officers making the decision. Immigration Bills Pass in US House of Representatives

[vc_row][vc_column][vc_column_text]The US House of Representatives passed two expansive immigration bills yesterday, one benefitting "Dreamers" and TPS holder and one benefitting agricultural workers.  The American Dream and Promise Act was passed with a vote of 228 to 197 and the Farm Workforce Modernization Act passed by a vote of 247 to 174.  The fate of both bills now rests in the US Senate, where passage is unclear.  Millions of undocumented immigrants could benefit if these bills become law, allowing them to work and live in the United States without the fear of deportation and to eventually seek US citizenship.  The two bills include similar provisions found in the US Citizenship Act of 2021 that we have previously blogged about, but are more focused on specific pieces of that larger legislation. The American Dream and Promise Act of 2021, introduced by California congresswoman Lucille Roybal-Allard, would enable Deferred Action for Childhood Arrival (DACA) recipients, undocumented immigrants who were brought to the country as children who do not have DACA protections and meet certain requirements, and recipients of Temporary Protected Status (TPS) or Deferred Enforced Departure (DED) to apply for conditional permanent residence for 10 years.  Full lawful permanent residence would be available to applicants who have earned a college degree or are in the process of earning a college degree, served honorably in the military for at least two years, or have worked in the country with authorization for at least three years.  All House Democrats and seven House Republicans supported the bill's passage. The Farm Workforce Modernization Act of 2021, introduced by California congresswoman Zoe Lofgren, would allow immigrant farmworkers who have worked in the country for at least 180 days in a 2-year period to apply for a temporary, renewable legal status.  Depending on previous work history, these workers would eventually be allowed to apply for permanent residency after four or eight years of additional agricultural work.  It would also extend the validity of an H-2A visa to three years.  All but one House Democrats and thirty House Republicans voted in favor of the bill. Both bills will now move to the US Senate, where the outlook of passage is murky.  The bills would likely need the support of all Democratic Senators and at least 10 Republican senators before the bills can become law. H-1B Registration Period Open Now, Ends March 25

[vc_row][vc_column][vc_column_text]H-1B season officially opened last week with the opening of the H-1B Electronic Registration Process.  For 2021 (Fiscal Year 2022), the registration period is from March 9, noon EST to March 25, noon EDT.  The electronic registration process, implemented by United States Citizenship and Immigration Services (USCIS) only last year, acknowledges that in a typical year, the number of applications is larger than the total number of visas.  In years past, every applicant had to submit the lengthy H-1B application and associated fees, prior to the lottery.  If the applicant was not selected in the lottery, the time, effort, and money spent on the application essentially went to waste.  Now, applicants only need to register electronically and pay a $10 fee.  They only need to submit an official application and pay necessary fees If they are chosen in the lottery, significantly reducing time and paperwork for the applicants. When the system was implemented last year, the process seemed to work without too many complaints.  The American Immigration Lawyers Association (AILA) offered feedback of the system late last year, along with recommendations on how to make the system work better.  Most of the recommendations focused on difficulties users encountered during data entry and account creation.  On March 5 of this year, USCIS issued guidance addressing some of the "common mistakes" made using the electronic registration service.  According to USCIS, the top two user errors were creating the wrong type of account and entering the beneficiary more than once.  The USCIS has an FAQ for the electronic registration process. When electronic registration ends on March 25th, the lottery process will take place shortly thereafter.  H-1B seekers who are chosen in the lottery should be notified of their selection by USCIS before the end of March.  Petitions for H-1B visas can be filed as early as April 1st. Springing Forward, Cautiously

[vc_row][vc_column][vc_column_text]Daylight Saving Time begins this Sunday at 2:00 am, at which time time adjusts one hour ahead to 3:00 a.m.  Most of the United States, including California, participates in Daylight Saving Time, though there has been discussion about abandoning the practice.  In fact, California voters passed 2018's Proposition 7, which gives the California State Legislature the authority to change or end Daylight Saving Time if permitted by federal law.  The vote itself did not end the practice of Daylight Saving Time and the California legislature has not yet voted in favor to change it, so we are again primed to "spring forward" this weekend. Be warned, entering Daylight Saving Time is associated with an increase in the number of car accidents.  Scientists estimate that the average person loses about 40 minutes of sleep because of the spring forward.  Drowsy driving is one of the most dangerous driving habits, causing an estimated 328,000 crashes per year (according to AAA).  When millions of sleep-deprived drivers commute on Monday, the risk of a car crash for every driver is higher than normal.  If you are one of those drivers on Monday, try to get some extra sleep to make up for the lost hour and stay vigilant on the roads.  And then, if you are commuting to work, be extra cautious if you typically perform potentially dangerous tasks! Venezuelan Nationals Granted Temporary Protected Status (TPS)

Yesterday afternoon, the Biden administration announced that it would be granting Temporary Protected Status (TPS) to eligible Venezuelan nationals.  The order could provide around 320,000 Venezuelans work permits and protections from deportation.  The Biden administration made the decision after determining that it is not safe for Venezuelans currently in the United States to return to their home country due to economic conditions and political instability.  TPS protections for Venezuelans will be in effect until at least September of 2022. The designation fulfills one of President Biden's campaign promises and gives a clear indication as to the trajectory of immigration policy under his administration.  When we have previously blogged about TPS, it was mostly about the Trump administration's attempts to end the program for certain nationals or the court cases stemming from those attempts.  Since the inauguration of President Biden, our immigration blogs have been about focused on the expansion or planned expansion of legal rights for immigrants. The TPS designation will be available for any undocumented Venezuelan national who was living in the United States on Monday, March 8, 2021.  Eligible immigrants will have six months to complete an application process and pay the necessary fees.  When designated, recipients of TPS can work legally and live without fear of deportation.  TPS is temporary and may or may not extended when the time period expires.  Whether or not TPS protections are extended is typically determined by the conditions of the immigrants' home countries and whether or not it is safe for them to return.
