Jack worked at the LA Department of Water and Power for over 35 years where he retired in 2006 as Senior Manager in charge of the Power Engineering Organization. Over the last 12 years Jack was responsible for putting together the W&PA website and virtual museum. The museum is the largest of its kind, consisting of over 20,000 images, including background information related to the history of Los Angeles and Southern California.

Temporary Protected Status Recipients who Entered US Unlawfully Ineligible for Green Cards

[vc_row][vc_column][vc_column_text]The United States Supreme Court issued a ruling today that could affect hundreds of thousands of recipients of Temporary Protected Status (TPS).  In a unanimous decision, the court ruled that TPS holders who unlawfully entered the United States are ineligible to seek permanent residency because they do not meet the "admitted" requirement to receive a green card.  The ruling could affect about 400,000 TPS recipients from 12 countries. The ruling only prevents TPS recipients who were not legally admitted to the country from pursuing a green card.  It does not remove TPS status, change TPS benefits, or otherwise alter the existing TPS program: TPS recipients are still protected from deportation and can legally seek employment in the US.  TPS holders who entered the country legally can still seek to become permanent residents, even if their visas had expired and were undocumented prior to being granted TPS. The Supreme Court case, Sanchez v. Mayorkis, involved Salvadoran man Jose Santos Sanchez, who entered the US as an undocumented immigrant in 1993 and was granted TPS in 2001 after a 7.6 magnitude earthquake struck the Central American country.  In 2014, Sanchez applied for permanent residence and was found ineligible.  The case made its way through the entire court system before the final ruling was issued today. TPS faced an uncertain future during the Trump administration but has likely entered a more stable situation under the Biden administration.  However, with this court ruling, there may be few options for TPS recipients who entered the country without being admitted from finding a permanent future in the United States.  If TPS were to end for any of the 12 countries whose citizens are currently eligible for TPS, those citizens would be expected to return voluntarily to their home countries or risk deportation from the US. Supreme Court Rejects Johnson & Johnson Appeal of $2 Billion Talc Verdict

Johnson & Johnson (J&J) Baby Powder and other J&J talc-based products have been linked to ovarian cancer, leading to thousands of lawsuits and many multi-million dollar jury verdicts.  One such case was decided in July 2018, where 22 women and their families were awarded $4.7 billion by a Missouri jury.  The original award included $550 million in compensatory damages and $4.14 billion in punitive damages, which was later reduced to about $2 billion overall.  Two of the 22 women were also dropped from the lawsuit at that time. On Tuesday, the US Supreme Court declined to hear an appeal by J&J to vacate the $2 billion verdict on the grounds that the Missouri courts should not have combined the 22 cases together, which J&J argues confused the jury due to differing state laws.  The court did not indicate why it rejected the appeal. It is unclear whether J&J plans to appeal the Missouri verdict on other grounds. See the full news report here. J&J maintains that its products are safe.  Key to many of the trials was a trove of J&J internal documents that documented its raw and refined talc sometimes being contaminated with asbestos, a known source of cancer, which J&J kept hidden from regulators and the public.  Reuters ran a special report on this topic in December of 2018 and can be found here. 979 Arrested by CHP for DUI over Memorial Day Weekend

[vc_row][vc_column][vc_column_text]Hundreds of drivers across California were arrested by California Highway Patrol (CHP) on suspicion of driving under the influence (DUI) over Memorial Day weekend.  CHP had announced a Maximum Enforcement Period (MEP) would be in effect for the entirety of the weekend from Friday 6:01 p.m. through Monday 11:59 p.m.  On Tuesday, CHP stated that 979 arrests were made during the 78-hour MEP. CHP also announced that at least 35 people were killed in car crashes across California during the MEP, an increase of 13 percent from 2020.  The majority of the traffic fatalities were not wearing a seat belt.  CHP did not indicate if any of those arrested for DUI were involved in any of the fatal collisions. The legal penalties for driving under the influence or driving while intoxicated can be severe.  A DUI Conviction can result in jail time, community service, probation, fines and court costs, and a suspended driving license.  The penalties can be more severe if the driver has a previous DUI conviction, causes a car collision, injures anyone, or causes property damage. When Treatment for a Work Injury is Not Helping

[vc_row][vc_column][vc_column_text]One promise of workers' compensation benefits is to allow an injured worker to seek medical treatment.  Regardless of how a work injury occurs, where it occurs, or who or what is to blame for the incident that led to the injury, workers hurt on the job can seek medical treatment for as long as necessary, until they are deemed fully recovered.  There are some work injuries, however, that will never result in a full recovery, regardless of how much medical treatment is received. Obviously, no amount of medical treatment is going to help victims of catastrophic work injuries, such as paralysis or dismemberment, fully recover.  But many work injuries considered minor or moderate also never result in a full recovery.  When treatment for a work injury is no longer helping a patient recover, medical staff will declare the patient "permanent and stationary" (P&S) and stop performing further treatment.  Upon being declared P&S, an injured worker is considered permanently disabled and eligible for permanent disability benefits. The amount of permanent disability benefits received by an injured worker vary.  Upon declaration of P&S, medical staff produce a report that determines a "disability rating" from 0 to 100 percent based on several factors, including:
  • Severity of the injury
  • Pain levels, even after treatment
  • Ability to perform assigned work duties
  • Previous, non-work-related injuries
  • Future medical care
After a disability rating is assigned, it is used in a mathematical formula that uses several variables, including an injured worker's age and occupation, to determine permanent disability benefits.  Receiving permanent disability benefits does not mean that an injured worker can no longer work or even perform the same work duties as before.  It is only an acknowledgement that an injured worker has suffered a work injury and could not fully recover, even after medical treatment.
