[vc_row][vc_column][vc_column_text]Independence Day falls on a Sunday in 2021, leaving many people with the day off on Monday, July 5th and a three-day weekend.  Over the long weekend, AAA estimates that as many as 43.6 million Americans will be driving somewhere for the holiday.  If this estimate is accurate, this July 4th weekend would have the busiest roadways on record for the holiday, about 5 percent more than the current record set in 2019. The Independence Day holiday is typically one of the most dangerous holidays to be driving.  The Law Offices of Scott Warmuth wants to encourage drivers to be vigilant, avoid excessive speeds, and drive sober.  Have fun, but stay safe! Juul Settles with North Carolina for $40 Million

[vc_row][vc_column][vc_column_text]Vaping giant Juul has reportedly agreed to settle illegal youth-targeted marketing claims with the state of North Carolina for $40 million.  This is the first settlement that Juul has reached with a state but faces lawsuits from 13 other state governments and the District of Columbia.  Juul was accused of marketing its addictive electronic cigarette products at teenagers, who could not legally use their products, through social media and other youth-centric platforms.  Under pressure from the Food and Drug Administration (FDA), the company stopped selling flavored vaping products in 2019. Juul's settlement with the state of North Carolina includes the $40 million and a promise to not sell its flavored vaping products until it is given authorization by the FDA and will only advertise to adults over 21.  The $40 million will be paid over six years and will be used to fund anti-vaping efforts and research the health effects of e-cigarette and other vaping products. The US Government banned the sales of vapes that had fruit or mint flavor in 2020 and raised the legal age for buying tobacco products to 21.  The new policies have led to a decline in the rate of youth vaping, but overall use rates are still high.  The FDA decision on whether to allow certain vaping products is currently expected in September.  About 6.5 million tobacco-related products are currently facing review. Teddy Bedjakian is the restaurateur of Edwin Mills by Equator located in Old Pasadena. Teddy started at that location back when it was known as Equator Coffee House. He was the one who decided to rebrand, and thus rename, the café in order to survive and thrive against the competition between coffee shops during 2014. Surviving and thriving has been a part of Teddy's life since he was young. His family immigrated to the US when he was 7 years old from Armenia where they were being targeted. Growing up Teddy describes himself as a tough kid, from living in a tough neighborhood during the time when Pasadena was not the prime place to hang out.

Currently Teddy has brought life back to the alley where his restaurant resides in Old Pasadena, while going through all the difficulties the pandemic has presented to him. He enjoys bringing the history of Pasadena, particularly the building that houses his restaurant, to the awareness of all who visit his establishment.

Riding Bicycles Safely this Summer

It is officially summertime!  After the challenges of 2020, lots of people are excited to get out and about this summer.  For many, that means taking to the streets and trails on a bicycle.  Learning to ride a bicycle is something that most of us learn how to do.  Learning to ride a bicycle safely, however, is something that is not.  Riding a bicycle can be dangerous, especially in a city setting.  Following these safety tips can help you reduce the risk of being seriously injured in a bicycle accident. Wear Safety Gear
  • Bicycle Helmet - While cyclists over the age of 18 are not legally required to wear a bicycle helmet in California, wearing a helmet can save your life in the event of a crash.  Helmet have been found to protect against head injury, traumatic brain injury, face injury, and death.
  • Lights and Reflectors - California law requires that bicycles have a white headlight, a rear red reflector, and white or yellow reflectors on the pedals while being operated at night.  From a safety standpoint, the more visible your bicycle is to motorists, the safer you are.
  • High-visibility Clothing - There is a reason many bicycle jerseys are colored in bright neon.  It is safer for bicyclists when drivers are aware of their presence.
Obey the Rules of the Road
  • Bicycles are Vehicles - In California, cyclists must follow all traffic laws as if they were driving a car.  That means obeying all traffic signals and stop signs, riding on the right side of the road, and even following speed limits.  And yes, cyclists can be ticketed by traffic enforcement if they are spotted disobeying a traffic law.
  • Sidewalk Safety - California does not specify the legality of riding a bicycle on the sidewalk, leaving the decision up to local governments.  Some jurisdictions allow for cyclists to ride on the sidewalk while others outlaw it, so you may want to check before doing so.  Regardless, studies show that riding a bicycle on the sidewalk is much more likely to lead to a collision than riding on the road.
  • Crosswalk Safety - California also does not specify whether or not riding a bicycle in a crosswalk is prohibited.  Similarly, it is safer to walk a bicycle through a crosswalk than to ride through it.
  • Ride with Traffic - Cyclists should never ride against the flow of traffic.  Not only is it illegal, but it is incredibly dangerous.  A 1994 study concluded that riding against traffic increased accident risk by 360 percent and riding against traffic on a sidewalk increased accident risk by 430 percent.  Riding against traffic also increases the risk of a more serious collision.
Stay Vigilant
  • Assume You Are Invisible - Many drivers may not be actively looking out for bicycles on the road.  For cyclists, it is just safer to assume that no driver can see you and behave accordingly.  Avoid putting yourself in a situation that could become dangerous if a vehicle were to make a common maneuver, such as a turn or lane change.
  • Stay Out of Blind Spots - In an extension of the above tip, when you are biking in a driver's blind spot you actually are invisible.
  • Do Not Bypass Stopped Vehicles - Attempting to pass vehicles queued at a stop sign or stop light is dangerous, as it typically involves biking in blind spots.  Vehicles will not have a chance to react to your presence.
  • Be Wary Biking Near Parked Vehicles - Drivers who have parked their vehicles and are attempting to exit may not be looking for cyclists and could open their doors directly into your path.

Certain Asylum Criteria Returned to Pre-Trump Norms

[vc_row][vc_column][vc_column_text]An asylum rule issued by the previous administration that made it difficult or impossible for the victims of gang crime or domestic violence to receive asylum in the United States was revoked by the Biden administration on Wednesday.  The 2019 rule was issued at least in part to reverse a 2017 court decision that determined that a family targeted by a drug cartel would qualify under the "social group" classification of asylum eligibility.  Immigrants can seek asylum if they fear persecution because of their race, nationality, religion, politics, or inclusion in a particular social group. Under the rule that is being revoked, being targeted by gangs or because of one's gender was considered "private violence", not because of inclusion in a particular social group.  The revocation is not immediate and will follow the federal rulemaking process and allow for public comment.  Current asylum seekers may still have their cases adjudicated according to the revoked rule until the process is complete. Seeking asylum in the United States is no easy task, regardless of circumstance.  While the Biden administration has made the process less cumbersome by reversing some Trump-era policies, receiving asylum is not guaranteed. Immigration advocates welcomed the rule change, with the consensus being that while not perfect, the updated rule will allow for every asylum claim to be judged on the facts of the individual case.  The revocation of the rule was also hailed as a step forward, one that could save lives.  The revoked rule was originally criticized as cruel and afoul of legal precedent. Injured Workers Are Protected, Even if Employer Is Uninsured

If a business does not purchase workers' compensation insurance for its employees, any employee injured on the job can also sue the business for damages.
