There are several guidelines as to how evidence can be collected during the course of an investigation.  If those guidelines are not followed properly, evidence collected improperly is subject to suppression.  For example, if incriminating evidence is discovered in a search that does not have a proper warrant, prosecutors would not be able to use that evidence against you.  Suppressed evidence is inadmissible in court, helping a defendant's case.

Crafting a truthful timeline of events

When defendants take the stand they often face cross-examination from prosecutors asking leading questions designed to discredit their story.  Defendants and criminal defense attorneys can work together to reconstruct a truthful timeline of events to provide a defense that makes sense to a judge and jury.  Cross-examination can be stressful, but when understanding what happened in a broader sense, a defendant can answer a prosecutor's question truthfully without becoming flustered or confused.

Is DACA Really Going to End on March 5th?

[vc_row][vc_column][vc_column_text]New reports have surfaced that if Congress is unable to act legislation protecting so-called Dreamers, President Trump may extend the Deferred Action for Childhood Arrivals (DACA) program past it's current March 5th expiration.  It is unknown how long that extension would be, if there would be an additional period to renew DACA permits, if legal challenges to the program would resume, or how likely an extension is to occur.  The deadline to renew DACA permits for an additional two years passed on October 5th. The speculation about the March 5th deadline not being a true deadline started with a tweet last month, but interest was renewed last night when Oklahoma Senator James Lankford made comments about the program after a town hall meeting.  According to reports, Lankford and Trump discussed the program last month on a phone call. Dreamers are young immigrants who were brought to the United States illegally as children.  In order to be eligible for DACA, applicants needed to have continuously lived in the United States for at least five years, received an education, and remained out of serious legal trouble.  DACA allowed these undocumented immigrants to legally live and work in the United States.  It is estimated that about 690,000 currently have DACA permits. DACA Renewal Deadline is TODAY!

ICE Agents Arrest 167 in L.A. Area

[vc_row][vc_column][vc_column_text]On Thursday, Immigration and Customs Enforcement (ICE) agents announced that an immigration sweep targeting so-called sanctuary jurisdictions was conducted over the previous few days. According to ICE, 167 immigrants were arrested in Los Angeles and surrounding communities. The target of the raids were purportedly undocumented immigrants with criminal records or who had been identified as gang members. ICE stated that Deferred Action Against Childhood Arrivals (DACA) recipients were not targeted in the raid. Sanctuary jurisdictions, including Los Angeles, San Francisco, and every county government in California, limit the cooperation between law enforcement and immigration authorities. There is no clear definition of what a sanctuary city is and policies vary between cities. In the city of Los Angeles, law enforcement will not keep undocumented inmates jailed beyond their release date without a warrant. In the recent raids, more than 450 people were arrested across the country. Of those arrested, about 1 in 3 did not have a criminal record. Read more about this story at the L.A. Times. Driving Slower than Average on the Freeway? Move Right!

After a drive to Las Vegas, this writer was reminded of perhaps one of the best explainer videos to ever surface. The article, a 2016 feature from Vox, explains "why you shouldn't drive slowly in the left lane". In short, you shouldn't drive slowly in the left lane because it makes traffic worse and more dangerous for everyone. It's also illegal. With the multi-lane freeways of Southern California, the concept of 'right' and 'left' lanes begin to blur. While we expect trucks and slower vehicles to stay in the right lanes, every driver will recognize that this is often not the case. Making matters blurrier for multi-lane freeways is the carpool lane, splits, merges, and even some left-lane exits. But nowhere does the left lane right lane divide appear brighter than between Barstow and Primm on the I-15. With many drivers eager to see the bright lights of Las Vegas and an always plentiful convoy of big rigs, slower vehicles in the left lane can create huge traffic slowdowns and more dangerous driving conditions. It's always best, especially on a two-lane highway, to only use the left lane for passing. DACA Renewal Deadline Rapidly Approaching

The program, as it currently stands, is no longer accepting new applications and will cease accepting renewal applications after the stated deadline. DACA recipients, sometimes called Dreamers, who have an existing permit that expires on or before March 5th have the opportunity to renew their status for an additional two years. However, DACA renewal applications must be filed by October 5th, 2017! The DACA program offered certain young, undocumented immigrants brought to the U.S. as children protection from deportation and the ability to obtain a work permit.  Since 2012, DACA protections have been issued to about 800,000 immigrants, many of whom have no memories of their home countries. It's estimated that about 150,000 people are eligible to renew their DACA status one last time. Many Dreamers could have a different pathway to permanent residency, but have not had a recent legal consultation to find out about other green card options unrelated to DACA. Right now, the future for Dreamers appears uncertain, but regardless of the program's future it is best to have an immigration attorney review an individual's background for any other immigration benefits that may apply. Amazon’s 1-Click Technology Patent Expires

At the height of the dotcom bubble, US patent 5,960,411 was granted to a small book retailer that changed the way consumers made online purchases, making an online transaction faster.
