8th Child Killed by Recalled IKEA Dresser

Topics: Consumer Law

Feature
[vc_row][vc_column][vc_column_text]IKEA Malm dressers were originally recalled in June 2016 due to the deaths of several children and the violation of United States voluntary standards.  After the death of Buena Park toddler, 2, was announced recently, IKEA is re-announcing a recall of 29 million chests and dressers.  The store is offering full refunds or wall mounting kits for anyone who contacts them. An attorney representing the Buena Park family has made the charge that IKEA did not properly notify customers affected by the recall.  According to the family, they provided IKEA with home and email addresses, but never received any communication about the recalled dresser. According to IKEA, at least 1 million dressers have been returned for a refund or retrofitted with wall-mounting kits.  Over 8 million Malm brand dressers, the kind involved in the death of the Buena Park toddler, were sold between 2002 and June 2016. If your family has purchased a chest of drawers or dresser from IKEA in the past twenty years, ensure that the furniture is properly mounted to the wall to protect your children.  The list of recalled products from IKEA can be found here. If you or a loved one has been injured by a recalled product, call the Law Offices of Scott Warmuth at 888-517-98888 for a free legal consultation.[/vc_column_text][/vc_column][/vc_row]

DACA Renewal Applications Delayed in Mail Can be Resubmitted

Topics: Immigration

Feature
[vc_row][vc_column][vc_column_text]United States Citizenship and Immigration Services (USCIS) has reversed course and will allow DACA applications delayed in the mail as well as potentially thousands of applications left in a mailbox overnight to be resubmitted.  Applicants who are able to prove that their documents were delayed in the mail or were delivered properly on the deadline and were rejected as late anyway will be allowed to reapply for renewal.  The Deferred Action for Childhood Arrival (DACA) renewal application deadline was October 5th. While the USCIS has promised to reach out to applicants whose applications were rejected as late, it is unknown if or when this outreach will happen.  Many lawyers representing DACA applicants have reported seemingly arbitrary denials and potential bad faith examinations of applications.  Only after it became widely-reported that applications sent weeks early experienced mail delays and applications delivered on the deadline were rejected as late did the government offer recourse. The ultimate fate of the nearly 800,000 Dreamers whom have benefited from DACA is still uncertain, with news on the topic changing all the time.  The Law Offices of Scott Warmuth offers immigration assistance and can help current and former DACA recipients examine possible avenues for legal immigration.  Call us today at 888-517-9888 for a free immigration consultation.[/vc_column_text][/vc_column][/vc_row]

The Art of Creation

Topics: Intellectual Property

Feature
[vc_row][vc_column][vc_column_text]The creation of a new idea isn't always the result of an epiphany. Many ideas are formed through a deliberative, refined process beginning with several 'rough' ideas and ending with a polished finished product. There are several methods one can use to help create that finalized idea. Using these methods and throughout the creation process, it's important not to overlook other matters, such as what will happen to your new idea. Being proactive through intellectual property law can help protect your soon-to-be idea through patents, trademarks, and copyrights. The Law Offices of Scott Warmuth can help you safeguard your hard work.  Call 888-517-9888 for a free intellectual property consultation. Think positive Self-doubt can sabotage any attempts at creative inspiration. "Knowing" that your desired outcome is just around the corner can help you focus and find the answers you are searching for. Start with 'why', not 'what' or 'how' "What" you are trying to achieve and "how" you are going to achieve will be a destructive cycle without understanding "why" you are trying to achieve. If you want to build a better mousetrap, understanding why you want to build a better mousetrap can guide the creative process towards your goal. If your goal is to save animals, you can focus on what and how to create a better mousetrap that accomplishes that goal. Limit familiarity Thinking outside the box is a cliche, but it's a cliche for a reason. A change of scenery, process, or materials can lead to an idea you wouldn't ordinarily think of. Take notes Thoughts can be fleeting. If you think of something, write it down before you forget! Follow the most promising path Brainstorming can lead to several answers to the questions of why, what, and how. Sort those answers into which can best accomplish what you're trying to. Having 'backups' can also drive further innovation. Don’t give up Negative thinking can lead to negative outcomes. If you're thinking about giving up, you're not thinking about a solution. Keep at it![/vc_column_text][/vc_column][/vc_row]

Several DACA Renewal Applications Denied Due to Postal Service Error

Topics: Immigration

Feature
[vc_row][vc_column][vc_column_text]In what can only be described as a 'worst nightmare', several Deferred Action for Childhood Arrivals (DACA) recipients filing renewal paperwork were denied due to delayed mail delivery. U.S. Citizenship and Immigration Services (USCIS) refused to consider applications received after the deadline of October 5th, regardless of when the applications were sent, issuing automatic denials. Many immigration advocates pointed to a previous application deadline in 2001, which only had a postmark requirement. According to New York Times reporting, at least 34 DACA recipients were rejected due to a United States Postal Service (USPS) delay in the Chicago area.  One particular example detailed in the story is an application being sent from New York on September 14th, arriving in Chicago on September 16th, but not being delivered until October 6th, a day after the deadline.  The USPS has apologized, but USCIS has only stated that they are not responsible and will not consider the delayed applications. Affected DACA recipients will lose their protected status as soon as their permit expires.  Legislation to address the status of the so-called Dreamers is currently stalled in Congress.  In some cases, DACA recipients may have another avenue to legal status in the United States.  The Law Offices of Scott Warmuth can help identify potential avenues for visas and permanent residency.  Call 888-517-9888 for a free immigration consultation.[/vc_column_text][/vc_column][/vc_row]

The First Rains Make the Worst Conditions

Topics: Auto Accident

Feature
[vc_row][vc_column][vc_column_text]Southern California is seeing it's first wet weather after one of the hottest summers on record.  The weather forecast in the San Gabriel Valley calls for a consistent chance of rain throughout the weekend, posing a risk of dangerous driving conditions, especially on the freeways.  The first rain after a period of dry weather cause terrible conditions.  The water mixes with all the dirt, oil, grease, and grime steadily accumulating throughout the summer, leaving roads incredibly slippery.  A downpour helps to clear away the buildup, but the forecast is for drizzle, leaving the roads slippery much longer! The rate of accidents on the freeways during wet weather in Southern California increases dramatically, sometimes as much as 300%!  It's important to protect yourself and your family if you take to the roads while it's raining.  There are several techniques to drive safer in stormy weather. Slow down In slippery driving conditions, it takes a lot longer to stop a moving vehicle.  Driving at a slower, safer speed can help you avoid accidents by being able to stop your vehicle quickly. Slow down sooner It takes much longer for wet brakes to stop a car.  Begin braking earlier than you usually would to ensure your car comes to a stop in time.  Slamming on your brakes could cause you to lose control of your vehicle. Do not tailgate Combining the two points above, if you're traveling too close to a vehicle that comes to a sudden stop, you may not be able to suddenly stop in time.  Leave extra space between you and any vehicles in front of you. Turn on your headlights If your windshield wipers are on, you are legally required to also have your headlights on.  Using your headlights in the rain increases visibility and the ability of others to see your vehicle. Keep your brights off Headlights help your visibility, but high-beams actually harm it. Avoid standing water If you see a puddle on the freeway, try to avoid it.  Hitting standing water creates the risk of hydroplaning which can cause you to lose control of the vehicle.  If you're unable to avoid a puddle and begin to hydroplane, do not hit the brakes!  Instead, take your foot off the gas until you regain control.  On surface streets, standing water could be much deeper than you think and you never know if you're going to hit something hidden beneath the waters.  If the water is too deep, you could cause damage to your vehicle's engine or brakes. Be prepared Ensure your windshield wipers, brakes, and headlights are working properly.  If you need to be somewhere at a specific time, try to leave early to allow for road conditions. If you're involved in an accident, contact a car accident lawyer in the San Gabriel Valley The Law Offices of Scott Warmuth provides exceptional service designed to help our clients recover from their injuries, fix their vehicles, and receive compensation for missed work and pain and suffering.  Contact us today at 888-517-9888 to receive a free injury consultation.[/vc_column_text][/vc_column][/vc_row]

Happy Halloween! Stay Safe on the Roads!

Topics: From Our Office, Personal Injury

Feature
[vc_row][vc_column][vc_column_text]From all of us at the Law Offices of Scott Warmuth, have a fun and safe Halloween! According to the Centers for Disease Control, children have about a 300% increased risk of being involved in a fatal pedestrian crash on Halloween when compared to other nights. To stay safe, we recommend following some common sense safety guidelines. Drivers: Stay Alert There are many more children on the roadways, driveways, and sidewalks then you are used to seeing, especially in residential neighborhoods. Drivers: Slow Down! Improve reaction your reaction time by slowing down to at maximum 5 mph BELOW the posted speed limit. Trick-or-Treaters: Wear Reflective Clothing When preparing children to walk around a dark neighborhood, the best defense is to ensure they're visible. Reflective clothing will warn vehicles that they are present. You could also put reflective tape on candy bags. Trick-or-Treaters: Avoid Sight-reducing Masks Not being able to see oncoming traffic can lead to accidents. Ensure that costumed children can see out of any masks without obstruction.

Happy Halloween!

Distracted Walking Ban Takes Effect in Honolulu

Topics: Personal Injury

Feature
[vc_row][vc_column][vc_column_text]In an effort to reduce pedestrian accidents and injuries, Honolulu has enacted a law designed to discourage distracted walking. The law allows police officers to issue tickets to any pedestrian checking their phone while crossing the street. Honolulu implemented the law as a response to having a large number of pedestrians struck by a vehicle while in a crosswalk. Passed in July, the distracted walking law requires a minimum $15 fine for first-time offenders with repeat violations costing as much as $99. The law is controversial; reports have shown that most pedestrian fatalities are caused by distracted driving, not distracted walking. Several major cities have tried to pass similar laws, but were not successful. The results of the Honolulu law will be watched carefully around the country. Should the law prove successful in reducing pedestrian injuries and deaths it's highly likely that other jurisdictions will follow suit. In Los Angeles, pedestrians are only involved in about 14 percent of auto accidents, but make up almost 50 percent of auto accident fatalities. Six percent of streets throughout the city are responsible for about 67 percent of fatalities. Any possible actions taken to reduce pedestrian fatalities, including Los Angeles' Vision Zero plan, is worth the chance. If you've been injured in an accident as a pedestrian or driver, call the Law Offices of Scott Warmuth today at 888-517-9888 for a free consultation.[/vc_column_text][/vc_column][/vc_row]

Is that Big Rig Tailgating?

Topics: Auto Accident

Feature
[vc_row][vc_column][vc_column_text]Coming soon to a freeway near you?  Big rigs tailgating each other at high speeds with only a few feet of separation.  Thought it may seem a disconcerting sight, new technologies will make the practice of 'platooning' a safer experience.  The same technology could help prevent trucks from rear-ending other vehicles. Platooning refers to the practice of two big rigs traveling in a pair, using each other to improve fuel efficiency by utilizing a truck's slipstream.  Slipstreaming, or drafting, is a proven method of increasing fuel efficiency, even inspiring a test on Mythbusters, which confirmed the 'myth'.  However, some safety experts still have concerns. The concerns do not have much to do with the platooning technology, the truck drivers, or even driverless trucks.  The biggest safety concern is other drivers on the freeway.  No one truly knows how drivers will react to seeing two or more trucks traveling 70 mph with only a couple of car lengths between them.  Will a driver try to cut through that small space to reach an exit?  Will drivers speed or slow to try and get around the convoys?  How would other drivers' behavior affect the technology?  Other questions have been raised as well. See the full news article here. None of these questions address the concerns of liability in the event of a crash.  With the safety improvements, it would be less likely that a big rig is actually to blame in a crash, but if one does happen, who is liable for damages?  The truck driver, truck company, software engineers, software company, or other entities could all have partial blame in a crash.  As the future quickly approaches, the Law Offices of Scott Warmuth will be ready to represent the victims of car accidents.  Call 888-517-9888 today for a free injury consultation.[/vc_column_text][/vc_column][/vc_row]
