DUI Arrests over New Year’s Holiday Up Over Previous Year

[vc_row][vc_column][vc_column_text]The California Highway Patrol (CHP) has announced that over the New Year's holiday, 936 people were arrested on highways across the state for driving under the influence (DUI).  The reported time frame of the arrests was Friday evening (6:01 p.m.) through Monday night (11:59 p.m.).  The number of arrests was a 22 percent increase over the same holiday weekend last year. The number of DUI arrests was not a significant increase over the 2017 Christmas holiday weekend, where 917 people were arrested under suspicion of DUI.  The statistics released by CHP do not offer insight into whether the arrests were alcohol-related, marijuana-related, or both.  With the legalization of recreational marijuana, CHP has sounded alarms in an attempt to prevent anyone under the influence of cannabis from getting behind the wheel.  Drivers suspected of driving while high will initially be given field sobriety tests until a clear legal standard for marijuana intoxication has been developed. Please Celebrate the New Years Holiday Responsibly!

[vc_row][vc_column][vc_column_text]New Years Eve and New Years Day are two of the deadliest holidays on the roads, and the main reason is alcohol-impaired driving.  About five times as many people are killed in drunk driving car crashes on New Years Day than an average day.  The hours between 6 p.m. New Years Even and 6 a.m. New Years Day are especially treacherous. While planning your New Years celebrations, consider taking precautions if you are going to be on the roadways.
  • If you or your party will be consuming alcohol, designate a sober driver
  • Do not allow anyone who has been drinking to get behind the wheel
  • Consider staying the night at your destination
  • If hosting a party, help arrange transportation and/or lodging ahead of time
  • If you see a drunk driver on the road, notify authorities

Fate of Dreamers Still Undetermined Heading in to 2018

[vc_row][vc_column][vc_column_text]In September, President Trump rescinded the Deferred Action for Childhood Arrivals (DACA) program, impacting about 800,000 immigrants commonly referred to as Dreamers.  DACA allowed these young immigrants, brought to the United States when they were children, the ability to work and go to school legally without fear of deportation.  With the program rescinded, about 100 DACA recipients are losing their legal protection every day.  Congress has vowed to protect these immigrants, but has not yet taken action. The DREAM Act, legislation to protect these immigrants, was first introduced to Congress in 2001.  Over the years it has taken many forms, and it is unknown would provisions would be included in a new DREAM Act for 2018.    The politics over the issue is messy.  Though it is believed that a majority of Congress would vote for a DREAM Act, no legislation has yet been debated.  DACA recipients are no longer able to renew their legal status, and beginning March 5th, previously approved applications will begin to expire. Train Derailment in Washington Under Investigation

[vc_row][vc_column][vc_column_text]The Amtrak train derailment in DuPont, Washington has called into question the general safety of mass transit systems across the United States. The train, taking a new route for the first time, derailed. Some passenger cars fell off an overpass above Interstate 5, killing three passengers and injuring dozens of passengers and drivers on the Interstate. Preliminary reports indicate that the train was traveling at 80 mph on a curve designated for 30 mph speeds. Positive train control (PTC), a technology designed to limit the speeds of trains automatically, was installed, but not yet activated. Southern Californians may remember when PTC became a national issue after the 2008 train crash in Chatsworth. In that crash, it was determined that an engineer was texting when he ran through a red signal and caused a collision, killing 25 people. Due to the Chastworth crash, Congress implemented a law requiring all railroads to use PTC technology by the end of 2015. The deadline has since been extended to the end of 2018. While train crashes like the Washington derailment tend to scare people away from riding public transportation systems, it's important to note that traveling by rail is still much safer than driving in a car. Traveling by car has a risk of fatality around 7.3 per billion passenger-miles while riding a train has a fatality rate of about 0.15 per billion passenger-miles. These statistics make the risk of a fatal car accident about 49 times greater than a fatal train accident. 115 Doctors Prohibited from Workers’ Compensation Program in 2017

[vc_row][vc_column][vc_column_text]A new law, Assembly Bill 1244, went into effect this year that prohibits doctors convicted of criminal or fraudulent activities from treating injured workers in the workers' compensation system. It was announced today that 21 providers have been suspended, bringing the total number of providers barred from treating injured workers to 121. The offenses leading to the suspensions range from accepting illegal kickbacks to fraudulently billing Medicare. The offenses and convictions may have happened years ago, but the suspensions from workers' compensation medical provider networks is only occurring now due to AB 1244. While a reduction in medical providers may seem like a bad thing for injured workers, removing providers convicted of fraud or other criminal activities from the system may not be such a bad thing. The U Visa

Many crimes go unreported and witnesses who are undocumented may be wary of testifying in court over fears that interaction with police will lead to removal from the country. ICE has been antagonistic toward undocumented immigrants and their aggressive tactics have caused immigrant crime victims to live in the shadows, making them more vulnerable to abuse. Sexual assault crime reports have dropped by 25% among Los Angeles' Latino population since the beginning of 2017 compared to last year. Reports of domestic violence have dropped by 10% according to a statement from police chief Charlie Beck earlier this year. In February, an undocumented woman was arrested almost immediately after she sought a protective order against an abusive ex-partner in El Paso, Texas. Before the executive order on immigration, many immigrant advocates would advise people that the police are there to help them.  Now they are telling immigrants to be cautions depending on where they live. A U Visa is a temporary legal status that allows immigrants to stay in the US as long as they cooperate with law enforcement. Pokémon Go May Have Caused Over 100,000 Accidents

[vc_row][vc_column][vc_column_text]A new study claims that Pokémon Go, the still popular augmented reality mobile game, may have been responsible for more than 145,000 traffic accidents across the United States in the first five months after the game's release.  Researchers analyzed crash statistics from Tippecanoe County in Indiana and extrapolated the uncovered data to span the entire country.  The results of the research are raising questions about distracted driving in the smartphone age. Traffic fatalities had been on the decline for several years before unexpectedly spiking in 2011.  Many experts believe the sudden trend reversal is directly linked to the prevalence of smart phones. The Pokémon Go study showed that the risk of an auto accident increased 26.5% near a Pokéstop, where players are more likely to be looking at their phone to receive in-game bonuses. Pokémon Go is not the only reason people look at their phones while driving or walking, but due the game's popularity, the increased risk was significant. With a population of about 186,000 people, Tippecanoe County reported 31 injuries and two deaths associated with the game. Distracted driving is a serious concern.
