Trade Dispute with China Could Affect Immigration

[vc_row][vc_column][vc_column_text]The Trump administration is set to limit visa length for some Chinese citizens due to concerns about intellectual property.  This news was leaked to the Associated Press last night by a U.S. official who had seen new instructions sent to United States embassies and consulates.  The exact details of the changes are not yet known, but the changes appear to target Chinese students and researchers in STEM fields. The purported changes do not affect the visa application process, but appears to limit the length of time a visa is valid to one year.  Student visas for Chinese citizens would still be valid for a maximum of five years, but U.S. consulates could move up the expiration date.  The decision to end visas early would be on a case by case basis. The changes have not been officially announced, but could possibly go in to effect on June 11.  With trade talks between the United States and China set to begin soon, it is unknown if this new policy will ever be enforced. Memorial Day Weekend Most Dangerous Weekend on the Roadways

Will There be a Vote on DACA?

[vc_row][vc_column][vc_column_text]An unlikely development in the U.S. House of Representatives could lead to a vote on the Deferred Action for Childhood Arrivals (DACA) program.  DACA is an Obama-era program that allows young undocumented immigrants brought to the country illegally as children to work legally in the United States without fear of deportation.  The Trump administration ended the program last September, but several court cases have prevented the program from terminating. DACA never received a vote in Congress.  That may be about to change.  Sponsors in the House of Representatives are gathering signatures for something called a 'discharge petition'.  A discharge petition is a written motion to put a bill on the House floor.  This method of getting a bill to the floor does not require House leadership approval, who currently oppose any bills pertaining to DACA.  In order for a discharge petition to be successful, a majority of House members must sign the petition. Successful discharge petitions are very rare, with only 25 petitions meeting the majority threshold in more than 80 years.  Even if the discharge petition addressing DACA is successful, there are no guarantees that any legislation will be passed by the House, and if it does pass the House, that the legislation becomes law.  This story will continue to develop over the next several weeks. Fatal Pedestrian Accidents Increasing

[vc_row][vc_column][vc_column_text]A new study published by the Insurance Institute for Highway Safety (IIHS) demonstrated that the increase in fatal car accidents involving pedestrians stemmed from different risk factors between 2009 and 2016 in the U.S.   SUVs were specifically identified as a reason for more fatalities, showing an 82 percent increase in the number of pedestrian deaths, significantly higher than other vehicles.  In the United States, nearly 6,000 pedestrians were killed in crashes in 2016. The study was conducted to examine potential risk factors for fatal pedestrian accidents. The study showed that overall fatal pedestrian crashes increased by 46 percent, but in urban areas the increase was 54 percent, on arterial roadways the increase was 67 percent, non-intersections increased by 50 percent, dark conditions were 56 percent, and SUV involvement increased 82 percent. Recommendations to stem the increase in pedestrian deaths include several road improvements and better lighting. See the full study here. Distracted Driving Continues to be a Problem

Massive information campaigns have not put a dent in distracted driving numbers. The National Highway Traffic Safety Administration (NHTSA) estimates that, on average, distracted driving results in over 3,200 deaths and 400,000 injuries every year. These numbers have been increasing over recent years.

Undocumented Immigrants Face New Policy of Zero Tolerance

[vc_row][vc_column][vc_column_text]Signalling a policy of zero tolerance, the Trump administration announced a plan to prosecute 100% of people entering the country illegally.  As a result of this plan, families will be separated by sending parents to jail and their children to the Office of Refugee Resettlement.  Attorney General Jeff Sessions likened a family attempting to enter the United States illegally to a smuggling operation.
"If you are smuggling a child then we will prosecute you, and that child will be separated from you as required by law. If you don't like that, then don't smuggle children over our border."
The Department of Homeland Security (DHS) has in the past separated families if the adults were prosecuted for a crime. The department announced that separating families is not a policy, but with a goal of 100% prosecutions, more families would be separated as a result. According to DHS, at least 700 children have been separated from their parents over the past few months. Affected children are typically sent to live with relatives or to shelters. According to the administration, the new policy will only apply to persons arrested attempting to enter the United States illegally. Temporary Protected Status for Hondurans to End

The program allowed about 57,000 people to live and work legally in the United States. TPS was enacted for Hondurans after Hurricane Mitch in 1998, which killed more than 11,000 people and left thousands homeless. TPS has remained in place for Hondurans due to rampant violence after a 2009 military coup. This decision continues a trend of ending TPS protections, some of which have been in place for decades. TPS has already been rescinded for recipients from El Salvador, Haiti, Liberia, Nepal, Nicaragua, and Sudan. Honduran nationals will be given between 12 to 18 months to return to Honduras or secure another means of permanent legal residency in the United States. Many of those affected by this decision have been in the country for nearly 20 years. A previous decision on the ending of TPS for Hondurans was delayed last year. Court Ruling Could Reopen DACA to New Applications

[vc_row][vc_column][vc_column_text]A federal judge in Washington D.C. issued a ruling that could potentially reopen the Deferred Action for Childhood Arrivals (DACA) program to first time applicants.  The Department of Homeland Security has not accepted new applications for DACA since September 5th of last year.  In his ruling, U.S. District Judge John D. Bates, a George W. Bush appointee, accused the decision to end DACA as arbitrary, capricious, and unlawful.  Bates ordered DHS to begin accepting new DACA applications but is allowing 90 days to allow DHS to provide legal reasoning to end the program. Other federal judges have ordered DHS to process DACA renewals past the initial March 5th deadline, of which at least 55,000 have been processed this year.  Those judges, however, did not order the program to reopen to new applicants.  It is not yet known how the Trump administration will react to this latest ruling.  Congress has not taken any actions to address DACA or protect Dreamers from deportation.  DACA allows eligible undocumented immigrants to get driver's licenses, attend school, and work in the United States legally.
