Immigration Provisions in Reconciliation Bill Face Setback Proposed immigration legislation in the United States hit a snag on Sunday after the Senate parliamentarian ruled that an attempt to provide legal status to millions of undocumented immigrants could not be included under budget reconciliation.  If that seems like a lot of random words put together, you're not alone.  What it basically means is that any vote to provide legal status for these undocumented immigrants will require a 60-vote bipartisan majority in the United States Senate, which most political observers believe is unlikely.  Supporters of immigration rights have stated that they will try alternative paths for immigration reform under budget reconciliation, which only requires 50 votes to pass.  This immigration news story will continue to develop. Biden Administration Wants to Raise Refugee Cap to 125,000 The Biden administration has proposed doubling the cap of refugees allowed into the United States from 62,500 to 125,000 beginning October 1.  The US State Department announced the plan on Monday.  The refugee cap was previously cut dramatically by the Trump administration to 15,000, the lowest level ever set by a presidential administration.  The proposed increase comes just after tens of thousands of refugees from Afghanistan prepare for resettlement into the country. Mass Expulsion of Haitian Immigrants Under Scrutiny The Biden administration has begun the process of expelling thousands of Haitian asylum seekers camped in Texas after a mass border crossing from Mexico.  It's believed that most of the Haitians attempting to reach the United States are migrating from South America.  According to authorities, nearly 16,000 Haitians were settled into the camp under and around a bridge in Del Rio.  Thousands of the asylum seekers have already been deported back to Haiti, with the Border Patrol stating that the remaining migrants will be deported by the end of the week.  The methods used by the Border Patrol have come under scrutiny by immigrants' rights groups. Letter of the Law – Navigating the “T” Intersection

[vc_row][vc_column][vc_column_text]It's your friend's housewarming party, and he has invited your family to his new neighborhood, one you are not familiar with.  It's late, it's dark, and you're in an unfamiliar area.  As you're trying to navigate the twists and turns of this incoherently constructed subdivision, you notice a mini traffic jam forming.  In front of you seems to be a big yard with some garden gnomes, but on both your left and right you spot other vehicles slowly approaching on a perpendicular road.  But weirdly, none of you seem to have stop signs.  Luckily, you are familiar with the intricacies of the "T" intersection after reading Scott Warmuth law blog. It is, in fact, your responsibility to stop at this particular intersection, even though you do not have a stop sign.  According to the California DMV Rules of the Road:
At “T” intersections without “STOP” or “YIELD” signs, yield to traffic and pedestrians on the through road. They have the right-of-way.
The DMV handbook also points out that there may even be some full 4-way intersections without any stop or yield signs.  If that happens, the first vehicle into the intersection has the right of way.  If two vehicles arrive at the same time, the vehicle on the right has the right of way, similar to how drivers would navigate a 4-way stop sign. Regardless of whether there are any traffic control devices at a T intersection, if you are approaching the intersection from the non-through road it is important to slow down and survey your surroundings.  You are being forced to turn and should evaluate the roads for any other vehicle traffic or pedestrians before proceeding.  This is especially important if you do not have a stop sign.  It is also important to note that even if you were on the through road, it is important to drive carefully, especially in residential neighborhoods. During his tenure on the council, he also served two terms as the president of the Chinese American Elected Officials (CEO) in Southern California. He was a delegate to the Southern California Association of Governments (SCAG) and he sat on the board of directors of several government and private agencies. His community achievement earned him the honor of being featured in a 2002 book entitled "Distinguished Asian American Political and Governmental Leaders".

Prior to becoming the President of AIEF (American International Education Foundation), Mr. Lim served as the executive director of California Institute of Public Administration (CIPA) from 2004 to 2013. He is currently an adjunct faculty member at California State University in Long Beach.

Work-Related Permanent Injuries

[vc_row][vc_column][vc_column_text]Under workers' compensation laws, when workers become injured they receive medical treatment.  Unfortunately, even the best medical treatment does not return some injured workers back to full health.  When further medical treatment will not improve an injured worker's condition, he or she may be declared permanent and stationary (P&S) by the treating physician.  The physician will then prepare a P&S report to document the current condition of the injured worker. Typically, P&S report list specific medical problems and describe how much pain you are experiencing. P&S reports also include details about your injury, and whether it will restrict your ability to work or require future medical care.  A P&S report will also estimate how much of your permanent injury was caused by your previous work duties.  If someone falls off a ladder, it's likely that the injury was caused 100 percent by work duties, as the injury would not have happened otherwise.  But if the injury is repetitive or could conceivably be at least partially attributed to your recreational indoor soccer hobby, the doctor will say so. When the P&S report is ready, your treating physician will send it to the claims administrator.  You have the right to receive a copy.  The report will affect future benefits, so obtaining a copy to make sure it's accurate is important.  If you have questions or believe some information is missing or inaccurate, you can speak with your doctor.  You also have the right to request a second opinion if you do not think the P&S report is correct. When the P&S report is ready, be sure to request a copy of it from the claims administrator.  The P&S report will affect your future benefits so it’s very important to make sure your report is accurate.  Speak to your treating doctor if you have questions or find any information that is missing or inaccurate.  Incorrect or missing information could result in a loss of benefits.  You have the right to challenge a P&S report and request a second opinion if you are unhappy with the results. Traffic Stops – Can an Officer Search Your Car?

[vc_row][vc_column][vc_column_text]Being pulled over by a police officer is not a pleasant experience for anyone.  Understanding your rights and knowing what to do (and what not to do) during a traffic stop can prevent an already unpleasant experience from escalating into something much worse.  Police officers are generally not allowed to search your vehicle without a good reason.  However, suspicious behaviors or negative interactions with an officer can be used as justification to search your vehicle, which is allowed when the officer has probable cause to believe you or a passenger may be involved in criminal acts.

What to Do During a Traffic Stop

  • When you see flashing lights or hear a siren, prepare to pull over.  Turn on your hazard lights to indicate you are pulling over, then find a safe location to do so.  Always stop on the right side of the road.  Pull as far over off the road as you can.  Avoid blocking traffic.
  • When safely stopped, turn off your car's engine and radio.  If it's night time, turn on your interior lights.  Keep your seat belt on.  If it's a marked police vehicle, roll down your window.  If the vehicle is unmarked, roll down your window when the officer shows you his or her credentials.  Keep both hands on your steering wheel.  Note that this is NOT the time to gather your vehicle documentation.
  • It may take a few minutes for the officer to approach your vehicle.  This is normal!  The officer is likely retrieving information about your vehicle.  Do not exit your vehicle or make any sudden movements.
  • Remain calm and be polite when speaking to the officer.  Do not argue, as it's counterproductive.  Provide your driver license, proof of insurance, and vehicle registration when the officer requests it.
  • Be honest with the officer, but avoid self-incrimination.  If the officer asks if you know why you were pulled over and you genuinely do not know why, you do not have to guess why.  Remember that you have the right to remain silent.
  • If you receive a ticket, you can sign it.  Signing a ticket only acknowledges receipt of the ticket and is not an admission of guilt.

What Not to Do During a Traffic Stop

Pretty much anything that's the opposite of what you should do is something you shouldn't do during a traffic stop.
  • Don't continue to drive.  Fleeing from a police vehicle is a serious crime.
  • Don't leave your vehicle unless requested.  If you attempt to leave your vehicle at any time the officer may assume you're trying to flee.
  • Don't refuse direct requests.  Refusing the order of an officer can lead to your arrest.
  • Don't be confrontational.  Having a heated argument with an officer doesn't do anyone any good and only invites trouble.
  • Don't lie.
