Car Accident Injuries Not Always Immediately Apparent

Topics: Auto Accident

Feature
[vc_row][vc_column][vc_column_text]Car accident victims may not feel pain immediately after the crash and incorrectly assume they have not been injured.  Only after a few days do these victims begin to feel a pain in their neck or back.  This situation is fairly common. If you begin to experience aches or pains a few days after a car a crash, you should visit a doctor immediately, even If you told the insurance company that you were not injured.  Neck strain resulting from whiplash can be an expensive and painful injury.  If you do not receive medical treatment within a couple of weeks, it will become difficult to prove that your injuries were caused by the accident. Just as important as seeking medical treatment is to notify your insurance company of your injuries in a timely manner.  The insurance companies follow standard criteria to evaluate the type and severity of every injury, and one of those criteria is how quickly you sought and received medical treatment after the accident occurred.  If you have legal representation, your attorney will notify the insurance company on your behalf. Insurance adjusters will want updates on your medical treatment.  Adjusters will contact victims who have not hired an attorney directly.  If you have not obtained representation, be sure to avoid contradictory actions and statements that appear to contradict your injury claim.  Those actions include missing doctors’ appointments and saying that you’ve completely recovered. If you do not have an attorney, it’s also important to keep track of all your medical records and lost income.  You will be able to seek compensation for your medical costs, lost wages, pain and suffering, and possible future damages.  Experienced attorneys will be able to handle your medical records and documents while negotiating compensation on your behalf, making the insurance claim process easier. If you've suffered an injury in an car crash, call the auto accident attorneys at the Law Offices of Scott Warmuth today at 888-517-9888.  We offer free initial consultations and contingency fees, so you will only be charged attorneys fess after we win your case.  We can answer any questions you may have about your car accident case.[/vc_column_text][/vc_column][/vc_row]

Bird is the Word (at the Emergency Room)

Topics: Auto Accident, Personal Injury

Feature
[vc_row][vc_column][vc_column_text]Dockless electric scooters such as Bird, Lime, and Razor have taken over city streets in California, much to many city's dismay.  So much so that Beverly Hills and West Hollywood outright banned the devices.  Several other cities have enacted restrictions until e-scooter regulations can be put into place.  Much of the conversation about electric scooters has been about the clutter left after riders complete their journey.  Not enough of the conversation has been about safety. The risk of personal injury to riders and pedestrians is significant.  Hospitals have been reporting scooter-related injuries almost immediately after the devices hit the streets.  These injuries have ranged from scrapes and bruises to concussions and other serious head injuries.  While riders are required by law to wear helmets, few do.  And should a rider suffer injury, there may be minimal recourse in pursuing damages.  Users of e-scooters are required to agree to terms severely restricting their ability to hold the e-scooter companies liable.  Even if the scooter itself malfunctions, it may be difficult to obtain legal damages. Injured pedestrians would have legal recourse.  For example, if you are walking down the sidewalk and are struck by an electric scooter, the person on the scooter would be liable for your injuries.  However, identifying the person who ran into you could be difficult, as scooters don't have easily identifiable markers or license plates.  If you are injured by a dockless scooter, attempt to obtain as much contact information as possible.  Scooter riders who are following all the rules of the road and are struck by a car would also have legal recourse, much the same as if the scooter operator was a bicyclist or pedestrian. If you or a loved one has suffered an injury related to a Bird, Razor, or Lime electric scooter, call the Law Offices of Scott Warmuth today at 888-517-9888.  We can tell you if you have a potential personal injury legal case.[/vc_column_text][/vc_column][/vc_row]

Gwyneth Paltrow’s Company Goop Settles False Advertising Lawsuit

Topics: Consumer Law

Feature
[vc_row][vc_column][vc_column_text]Goop, a wellness company founded by actress Gwyneth Paltrow, has quickly settled a lawsuit filed last week by several California counties over advertising claims deemed suspect.  The lawsuit alleged that the company advertised its products using claims that were not approved by the Food and Drug Administration (FDA) and that the claims themselves were not supported by any legitimate evidence.  The lawsuit was seeking remedy for false and misleading advertising as well as unfair competition. Goop was marketing a blend of essential oils, Inner Judge Flower Essence Blend (Floracopeia), as a treatment for depression.  It was also marketing 'vaginal eggs', egg-shaped stones inserted into the vagina, as a treatment for hormonal imbalance, uterine prolapse, menstrual cycle regulation, and incontinence.  There is no scientific evidence that either product provides any of these purported benefits. The lawsuit was settled for $145,000 in civil fines and an agreement to no longer make claims about Goop products without reliable and competent scientific evidence.  Under the agreement, the essential oils and vaginal egg products can still be sold.  However, many doctors would recommend avoiding the latter product altogether, as a vaginal egg could be detrimental to your health. Read the lawsuit here. False and misleading advertising claims can put the public at risk of injury, illness, or worse.  Consumer protection laws exist to deter companies from making dangerous claims about their products, and to punish companies who do.  The Law Offices of Scott Warmuth helps clients who have been harmed by the false or misleading claims made by manufacturers and advertisers.  For a free legal consultation, call 888-517-9888 today.[/vc_column_text][/vc_column][/vc_row]

U.S. State Department Denying Passports to Citizens Born Near Mexico Border

Topics: Immigration

Feature
[vc_row][vc_column][vc_column_text]The Trump administration is denying passports to Hispanic citizens born along the U.S.-Mexico border, accusing them of using fake birth certificates.  In some cases, United States citizens have had their valid passports revoked, been confined to immigration detention, and/or face deportation.  There have been several anecdotal reports of military personnel and border patrol agents having their passports revoked because the government does not believe that they are citizens. The State Department has announced that people affected by this policy are people who have birth certificates filed by a midwife or birth attendant who was suspected to have sold Texas birth certificates to the parents of children who were born in Mexico.  This fraud was a real concern, with several dozen successful fraud prosecutions against these midwives.  However, these midwives also delivered thousands of babies in the United States.  Proving that the birth documentation is fraudulent has been difficult, leading many legitimate citizens to be swept up in this increased enforcement action. According to the State Department, those facing additional scrutiny are people whose birth certificate was filed by a midwife or birth attendant suspected of fraudulent activity or people who have both a U.S. and foreign birth certificate.  According to reports, the government is asking for obscure documents such as rental agreements or prenatal care records from as early as the 1960s.  And even if they do receive some of these documents, the government is still denying some passport requests. See the full news report here. The immigration landscape is changing dramatically.  The Law Offices of Scott Warmuth works to make the immigration process as simple and fair for anyone seeking to live and work in the United States.  For a free immigration consultation, call 888-517-9888.[/vc_column_text][/vc_column][/vc_row]

California Cash Bail Reform Bill Sits on Governor’s Desk

Topics: Criminal Defense

Feature
[vc_row][vc_column][vc_column_text]Senate Bill 10 (SB-10), the pretrial detention reform bill that could end cash bail in California, has passed the California Assembly and State Senate.  The bill now awaits a signature by Governor Jerry Brown, who has indicated he will sign it.  SB-10 would eliminate cash bail and replace it with a risk assessment to determine whether or not each defendant should remain in jail to await trial. SB-10 could have a significant affect on the criminal justice system.  Under the current cash bail rules, many defendants who are not considered a risk to public safety are stuck in jail simply because they cannot afford bail.  Supporters of SB-10 have argued that this creates a two-tiered justice system, with wealthy defendants who can afford cash bail being treated better than defendants who cannot afford bond.  Opponents, however, contend that judges will have too much power to keep defendants in jail. Risk assessments would consists of questionnaires to determine whether or not a defendant should be released pending trial.  Each assessment would examine each defendant's criminal history and social history to predict whether he or she will fail to appear in court or pose a risk to public safety, subject to judicial intervention.  Should SB-10 be signed into law, the risk assessment mechanism is expected to be refined over the next few years as data become available. The Law Offices of Scott Warmuth is diligent in ensuring that our defense clients are treated fairly by the justice system.  We fight to keep our clients out of jail while awaiting trial.  If you or a loved one is seeking an experienced criminal defense attorney, call us today at 888-517-9888.  We offer 100% free consultations with no obligation.[/vc_column_text][/vc_column][/vc_row]

DACA Lawsuits and Appeals Continue to Work Their Way Through Court

Topics: Immigration

Feature
[vc_row][vc_column][vc_column_text]Last Friday, a federal judge in Washington D.C. ordered the Trump administration to continue processing renewal applications for the Deferred Action for Childhood Arrivals (DACA) program.  The ruling of U.S. District Judge John D. Bates changes nothing for the time being.  The Trump administration announced it was ending DACA last year, but the program has been kept alive by several court rulings.  While not accepting new applications, the government has been processing renewals for several months. A separate legal challenge to the constitutionality of DACA is currently in a Texas federal court.  This lawsuit, rather than challenging the legality of the Trump administration's decision to end the program, instead challenges DACA as a whole.  The lawsuit was filed by seven states and is led by Texas Attorney General Ken Paxton.  The judge overseeing this legal challenge, U.S. District Judge Andrew S. Hanen, previously blocked an Obama era executive order based on DACA.  Should Judge Hanen rule in favor of Texas and the other plaintiff states, the government would have conflicting court orders.  The issue of DACA would most likely move to the Supreme Court where it faces an uncertain future. See the full news story here. Immigration advocates are urging DACA recipients to apply for renewals as soon as possible.  DACA status allows certain young immigrants to live and work in the United States without fear of deportation. The Law Offices of Scott Warmuth is an immigration law firm that helps DACA recipients seeking renewals and any immigrants seeking permanent residency in the United States.  For a free legal consultation, call us today at 888-517-9888.[/vc_column_text][/vc_column][/vc_row]

Not All Bike Helmets Created Equal

Topics: Personal Injury

Feature
[vc_row][vc_column][vc_column_text]Have you ever purchased a bicycle helmet?  Did you consider that the helmet you were purchasing may not have offered the best protection?  The Virginia Tech Helmet Lab and the Insurance Institute for Highway Safety created safety ratings for 30 different models of bicycle helmet.  It turns out that some bike helmets offer better protection than others. Bicycle helmets that boast multi-directional impact protection systems, or MIPS, offered the best protection.  MIPS creates a protective low-friction layer inside the helmet, leading to increased levels of safety.  In fact, the only helmets to receive a 5-star safety rating were helmets equipped with MIPS.  Those helmets are the Bontrager Ballista MIPS, Garneau Raid MIPS, Bell Stratus MIPS, and Specialized Chamonix MIPS. Helmets were tested using sensors monitoring six commonly impacted locations during bicycle crashes.  The helmets were tested in simulated bicycle crashes at two different speeds to determine how well each helmet would protect a wearer from a concussion.  Two helmet models, the Lazer Genesis and the Bern Watts, received a 2-star safety rating, or adequate. To see the IIHS bike helmet safety report, click here. The Law Offices of Scott Warmuth encourages everyone who rides a bicycle to always wear a helmet.  A bicycle helmet is the single most effective way to prevent head injury in the event of a bicycle crash.  If you or a loved one has been injured in an accident, call our offices today at 888-517-9888 to receive a free injury consultation.[/vc_column_text][/vc_column][/vc_row]

Recent Immigration Law News

Topics: Immigration

Feature
[vc_row][vc_column][vc_column_text]Immigration law has been front and center in the news again this week.  Several front-page stories could potentially change immigration to the United States as we know it. ACLU Files Lawsuit Against New Asylum Policies A few weeks ago, the Justice Department issued new guidance for federal immigration judges.  That guidance told immigration judges that they could no longer consider domestic or gang violence as grounds for asylum.  As a result of that change, there has been an increased level of asylum rejections because there is no "credible" fear of persecution.  Now, the American Civil Liberties Union (ACLU) has filed a lawsuit against the Trump administration arguing that the new asylum policy violates the law. See the full news story here. Trump Administration Plans to Limit Legal Immigration The Trump administration is expected to announce changes to immigration policy that would make it more difficult for immigrants to receive a green card and for green card holders to become United States citizens.  The expected changes would consider immigrants who have ever used popular assistance programs as not self-sufficient.  These programs include food stamps, the Affordable Care Act, and the Children's Health Insurance Program.  Immigration experts estimate that this change could affect up to 20 million immigrants. See the full news story here. DACA Faces Constitutional Challenge in Texas Court The legality of the Deferred Action for Childhood Arrivals (DACA) program is being challenged in a Texas courtroom this week.  The lawsuit, brought by Texas and six other states, is seeking to end the DACA program by claiming it is unconstitutional.  The judge hearing the case is the same judge who prevent the Obama administration from expanding the program back in 2015.  If the judge rules against DACA and orders the program be shut down, the government will face conflicting orders.  Previous judges have ruled that DACA must remain in effect.
