T nonimmigrant status, commonly known as T visa, is a part of the Protection Act for Victims of Violence and Human Trafficking that was promulgated by the U.S. Congress in October 2000. Although the T visa is a non-immigrant visa, it provides the holder with the treatment of temporary immigration. It allows the holder to enjoy the relief and related services of the federal government when the conditions are met. The holder can legally stay in the United States for up to 4 years, and has the qualification to apply for a job in the United States during this period. It is worth mentioning that T visa holder can apply for a green card by adjusting their status directly from T nommigrant status, and finally apply to become American citizens.

In short, if you want to apply for T visa, you need to submit Form I-914, Application for T Nonnimmigrant Status, and a letter of statement about human trafficking. The Immigration Department will keep the information you provide confidential to protect the safety of the victim. The application for T visa is free of charge. If the applicant needs to work in the United States, he/she can submit I-914 and apply for I-765 work card at the same time.

If the victim is under the age of 21, his/her spouse, unmarried children under the age of 21 and parents can apply for T visa together as eligible relatives; If the victim is over 21 years old, his/her spouse and unmarried children under 21 years old can apply for T visa together as eligible relatives. The relatives can also apply for T-visa and submit I-765 application for work card to obtain legal working status in the United States.
