F Visa Lawyers

US immigration law allows certain non-citizens who are immediate family members of US citizens and permanent residents to become lawful permanent residents based on specific family relationships. You can apply for IR visas if you are the spouse, unmarried children below 21 years of age, or parents of a US citizen; for more specific application information, please refer to our IR special column. If you are an unmarried 21-year-old child of a US citizen, the spouse or an unmarried child below or at 21 years of age of a permanent resident, or a brother or sister of a US citizen, then you can obtain a Green Card by applying for a preference immigrant visa.

"F2A/F2B Family-Based Second Preference

First Preference
F-1 is the first-preference family-based visa designed for unmarried sons and daughters of US citizens 21 years of age or older. Currently there is a quota of 23,400 for the first preference category.
If the beneficiary is an adopted child, he or she can apply for F-1 as long as the adoption procedure occurs before the adopted child turns 16 years old, and his or her parents have obtained legal guardianship for 2 years, and the applicant and the US citizen have been living together for 2 years (legal adoption procedures are completed before the applicant turns 16 years old, or the petitioner and the beneficiary have been living together for 2 years, of which the period of time preceding the adoption can be counted). Stepchildren, on the other hand, need their stepparent and biological parent to be married before stepchildren turn 18 years of age in order to be eligible for F-1.
If you are in the US, you can submit I-485 through the USCIS to petition your foreign-citizen family member to adjust to a Green Card within the US. If your family member is abroad, then your case will be referred to National Visa Center (NVC) to be reviewed, who will later redirect it to the US Consulate in your foreign-citizen family member’s country to be processed. "

F-3 Family Visa is a family-based third preference visa designed for married sons and daughters of US citizens. There is a total quota of 23,400 each year.
F-3 Third Preference Visa does not have a requirement on the beneficiary’s age, as long as they are married children of US citizens’ children. F-4 Visa has age requirements for the petitioner, who are required to be at least 21 years of age to apply for Green Card on behalf of their brothers and sisters and must have identical biological parents. In the case that the relationship between the siblings is not biological, the sibling’s stepparent and biological parent’s marriage needs to have taken place before their stepchildren turn 18 years of age. In the case of adopted brothers and sisters, then the adoption procedures must have had occurred before the beneficiary turns 16 years of age.
